A federal court has ruled against President Bush’s Executive Order blocking access to presidential papers and setting up a largely hidden process under which Presidents, Vice Presidents and their descendents can block their release indefinitely.

Legislation to overturn the Executive Order has been blocked by Kentucky Republican Senator Jim Bunning, and the National Security Archives, which brought the suit, says the ruling still leaves formers, friends, and family in charge:

“The court is enforcing procedural standards, but has avoided the hard questions about the role former presidents, former vice presidents, and their heirs can play when it comes to disclosure of presidential records…Unless the Executive Order is reversed or withdrawn, decisions about the release of records from this administration may ultimately be made by the Bush daughters.”
